Sec. 106-1. Drainage criteria manual adopted.
That the City of Springdale Drainage Criteria Manual, a copy of which is on file in the city clerk's office and made a part hereof as though set out herein word for word, is hereby adopted in its entirety.

Ord. No. 2999, § 1, called for the adoption of the drainage criteria manual and was added to this Code as section 106-1 as currently set out herein, at the discretion of the editor.

Sec. 106-8. Preservation of calculations.
In order that future developers may develop other areas within a water shed and upon complete and ultimate development of a drainage basin that all storm drainage systems within the basin are compatible and functional, the following requirements shall exist:
(1) That the engineer shall prepare and submit to the city one copy of the final calculations to be deposited in the archives of the city. These calculations with related drawings shall be prepared in accordance with the Water Pollution Control Federation Manual of Practice No. 9, dated 1970, as appears in Table XIII or Table XXIII of the manual.
(2) The preparation of this data shall be completed and submitted along with the final plat.
(3) The Water Pollution Control Federation Manual of Practice No. 9 (Design and Construction of Sanitary and Storm Sewers) shall be used as the reference manual for any items that are not covered by this chapter.

Sec. 106-9. Complaint and enforcement officer.
When a violation of this chapter occurs, or is alleged to have occurred, any person may file a written complaint. Such complaint stating fully the causes and basis thereof shall be filed with the chief city inspector. The chief city inspector shall record properly such complaint, immediately investigate, and take action thereon as provided by this chapter. The chief city inspector or his duly appointed or employed representative shall be responsible for enforcement of the provisions of this chapter and shall see to its proper administration.

Sec. 106-10. Provisions declared minimum requirements.
In their interpretation and application, the provisions of this chapter shall be held to be minimum requirements, adopted for the promotion of the public health, safety, morals or general welfare. Wherever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations, the most restrictive or that imposing the higher standards shall govern.

Sec. 106-11. Penalty.
Any person violating any provision of this chapter shall, on conviction thereof, be subject to the penalties in section 1-9, together with costs of prosecution. Each day such violation continues shall be considered a separate offense; and any architect, builder, contractor, agent, or other person who commits, participates in, or maintains such violation may be found guilty of a separate offense and suffer the penalties herein provided. Nothing herein contained shall prevent the city from taking such other lawful action as is necessary to prevent or remedy any violation.
