Thereafter, the terms of the members shall be four years. Any vacancies shall be filled in the same manner as the original appointment for the remainder of the unexpired portion of the term.

Sec. 90-27. Organization; compensation; expenditures.
The members of the planning commission shall organize and elect a chairman from among the members and a secretary, who may be a member or not. The president or members of the commission shall receive a salary, as established by ordinance, and allowances for actual expenses in connection with duties performed may be made. No expenditures for commission expenses shall be made by the commission, except those authorized by the city council.

Editor's note--It should be noted Ord. No. 3607, § 1, adopted Nov. 23, 2004, provides for an effective date of January 1, 2005, as pertaining to annual compensation and that the council member appointed to the planning commission shall be paid the compensation for both positions. Ord. No. 3607 is available for public review in the offices of the city.

Sec. 90-28. Powers and functions.
The city planning commission shall have the powers, duties and functions pertaining to planning commissions conferred upon the city for planning by law which include the power to adopt, adjust and enforce a plan for the coordinated and harmonious development of the city and its environs which would promote, in accordance with present and future needs, the safety, morals, order, convenience, prosperity and general welfare of the citizens; for efficiency and economy in the process of development; for the appropriate and best use of land; for convenience of traffic and circulation of people and goods; for safety from fire and other dangers; for adequate light and air in the use and occupancy of buildings; for healthful and convenient distribution of population; for good civic design and arrangement; for adequate public facilities, and for wise and efficient expenditures of public funds; and for other public purposes.

Sec. 90-29. Conformity with master plan.
When the planning commission shall have adopted the master plan of the city or of one or more major sections of districts thereof, no new street, square, park or other public way, ground, or open space, or public building or structure, or public utility, whether publicly or privately owned, shall be constructed or authorized in the city or in the planned section and district until the location, character and extent thereof is submitted to and approved by the commission. In case of disapproval, the commission shall communicate its reasons to the council which shall have the power to overrule the disapproval by a recorded vote of not less than two-thirds of its membership. If the public way, ground, space, building, structure or utility is one the authorization or financing of which does not, under the law or charter provisions governing same, fall within the province of the council, the submission to the planning commission shall be by the board, commission or body having jurisdiction, and the planning commission's disapproval may be overruled by such board, commission or body by a vote not less than two-thirds of its membership. Failure of the planning commission to act within 60 days after the date of official submission to it shall be deemed approval unless action is taken by the public board or commission to extend the time not to exceed an additional sixty (60) days.

Sec. 90-30. Redefining board of zoning adjustment.
The planning commission shall function as the board of zoning adjustment as established in Chapter 130: Zoning. In addition as the board of zoning adjustment, the planning commission shall serve as the board of adjustment as provided in Chapter 18: Aviation, Chapter 50: Flood and Flood Damage Prevention Regulation Code, Chapter 98: Sign, and Chapter 112: Subdivisions.
