Sec. 86-46. Fund; rules of procedure; guidelines.
Pursuant to amendment no. 31 of the constitution of the state, authorizing cities of the first class to vote a tax on the assessed value of real and personal property within such city, not to exceed one mill to pay pensions to retired police officers and to the widows and minor children of deceased police officers, and widows and minor children of deceased, retired police officers in such manner as shall be provided by law, was duly submitted to the voters of the city on November 7, 1972, at an election held in the city, and whereas, a consent of the majority of those voting on the question at the election was given by a majority voting in favor of the fund, and the levy of the tax, and whereas, the acts and statutes of the state, set forth the manner and procedure to be followed in the establishment of such a pension and relief fund for police officers in cities of the first class, and further provide the procedures for the establishment and administration of any such pension and relief fund, it is the intention and desire of the city council to follow A.C.A. § 24-11-401 et seq. as the rules of procedure and guidelines, and other laws or parts of laws of the state applying to the subject matter herein covered, because the ordinances of the city do not provide for the subject matter herein covered and contained, and the city council finds that this section is necessary and is hereby adopted for the immediate preservation of public peace, health, safety and welfare of the citizens of the city, and the above and foregoing provisions of state law are adopted herein by reference as completely as if set forth word for word herein. The city council hereby declares that an emergency exists and this section shall be in full force and effect from and after its passage and approval.
